Patent Infringement
The primary value of a patent lies in the rights it conveys to the patentee to exclude others from making, using, selling and importing into the United States products or processes covered by the patent. Determining whether the patentee will ultimately prevail in asserting these rights turns on the question of whether or not the accused product or process infringes the patent.
